The governing board of the City Council of Nájera has agreed to admit for processing the claim presented by a neighbor and initiate an administrative file of patrimonial responsibility, in order to determine whether or not there is such responsibility on the part of the Consistory and if it has the obligation to indemnify the applicant.
The neighbor claims to be compensated "for the damage caused to a Nissan X-Trail vehicle, due to the pothole in the Paseo San Julián speed bump, next to the entrance to the San Fernando school, towards the heated swimming pools, on the 29th of November 2021", noting that said damage "has consisted of steering breakage".
To substantiate his request, he provides photographs of the state of the road, and an excess invoice for the repair of the vehicle, quantifying the damage at 150 euros. In the agreement, which is sent to the interested party, it is also communicated that he has been appointed instructor of the file, which may be challenged within a period of ten days from the date he receives said notification.
In the same way, you are informed that the Department of Architecture and Urbanism of the City Council has been requested to issue the corresponding report on the state of the road where the incident occurred, as well as on any issues considered relevant to the procedure. The insurance company of the Consistory is also notified.
